11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of laws principles. Poland is chosen because one of the joint operators is habitually resident there and Polish law is fully aligned with European Union data protection and consumer protection rules.
Any disputes arising from or related to these Terms or the Website shall be resolved as follows:
- Good faith negotiation between the parties — you agree to contact us at [email protected] and allow a reasonable period for informal resolution before initiating formal proceedings.
- If negotiation fails, the dispute shall be submitted to the competent Polish courts having jurisdiction over the defendant.
Mandatory consumer protections. If you are a consumer habitually resident in a European Union Member State, nothing in these Terms deprives you of the protection afforded to you by provisions of the law of your country of residence that cannot be derogated from by agreement (Article 6(2) of Regulation (EC) No 593/2008 — "Rome I"). You may bring proceedings in, and invoke the mandatory consumer rules of, your Member State of residence.
Online Dispute Resolution. Consumers resident in the European Union may also use the European Commission's Online Dispute Resolution (ODR) platform available at https://ec.europa.eu/consumers/odr. We are, however, not obliged and not willing to participate in dispute settlement proceedings before a consumer arbitration board.
This clause on governing law will be revisited once the Website is operated by a registered legal entity; at that point, the governing law may be updated to reflect the seat of that entity.
12. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
13. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Project Founders regarding your use of the Website and supersede any prior agreements or understandings.
14. Multilingual Availability
These Terms are available in multiple languages. In the event of any discrepancy between translated versions, the English version shall prevail.
15. No Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it at a later time.
